Man not guilty in knife threat
BLACKFOOT -- A man charged with threatening the mother of his child with a butcher knife was found not guilty of aggravated assault by a jury Tuesday.
Hector Chalo Varela, 19, was alleged to have threatened the woman last June after a disagreement over child visitation. Varela was accused of brandishing the knife and making a motion as if to throw it at the woman. A guilty verdict would likely have meant Varela's deportation to Mexico, as he is not a naturalized citizen, although he has lived in the U.S. for most of his life, according to Varela's attorney, Manuel Murdoch. He said Varela's application for a visa has been pending for some time. Murdoch said the jury deliberated for approximately one hour before returning a not guilty verdict.
Varela still faces a felony charge for allegedly breaking a window in the Bingham County jail. Murdoch said Varela's preliminary hearing on the charge is scheduled for today before Magistrate Charles L. Roos. By Journal Staff
