Home Invader plea deal set

POCATELLO -- A suspect in a mid-February home invasion who eluded police for two weeks pleaded guilty to felony accessory to grand theft Monday as part of a plea agreement. Vaughn Steven Earley, 48, was originally charged with robbery and felony theft of handguns from a West Griffith home on Feb. 14. The resident was allegedly beaten during the home invasion, suffering broken teeth and black eyes. Earley was not implicated in the beating. The original information filed by the state contended Earley and two other individuals entered the man's home, beating the man and robbing him of $1,200 cash and five handguns.
The state amended the information pursuant to the plea agreement, dropping the robbery charge and amending the remaining charge to accessory to grand theft. The state also agreed not to pursue a persistent felony offender designation, and to request that the accessory charge run concurrently with 2004 convictions in Bannock and Minidoka counties. Sixth District Judge David Nye accepted Earley's guilty plea, but informed him that he would not be bound by the plea agreement without first reviewing a pre-sentence investigation report.
Nye set sentencing for Dec. 11. The maximum sentence for accessory to grand theft is five years. By John Bulger
