Probation for Aiding Felon
jbulger@journalnet.com
POCATELLO -- A local woman was granted probation Monday after her counsel told the sentencing judge that incarceration would likely result in the termination of her parental rights. Helen Destiny Rose Bosquez, 19, was all but sentenced to a three-year fixed, two-year indeterminate sentence with a 180-day retained jurisdiction stint for aiding a felon before her counsel pleaded with Sixth District Judge Peter D. McDermott to reconsider. Bosquez's attorney, John Souza, told McDermott that the six-month retained jurisdiction session would likely result in the woman losing her two children.
McDermott noted that Bosquez's children were currently in foster care. After inquiring of Bosquez's probation officer about her history on probation, McDermott relented, but warned the woman that he would tolerate no future blunders. "If you have a probation violation, I'm not going to care if you lose your kids," he said. "If you want to keep your kids, by God, you're going to listen to your probation officer."
McDermott addressed the incident which resulted in the charges for Bosquez, a high-speed chase in which Bosquez's companion, who was in possession of a gun, attempted to elude police. "Start having more respect for yourself and your kids and stop hanging around these losers," McDermott said.
McDermott then suspended the sentence, allowing Bosquez to remain on probation. By John Bulger
