Claim filed in I.F. shooting
IDAHO FALLS -- Parents of an Idaho Falls man fatally shot by a Bonneville County Sheriff's deputy during a chaotic car chase in February have filed a tort claim notice, naming Bonneville, Bingham and Bannock counties and numerous employees, as well as the Idaho Falls Police Department and several of its officers.

Rayce Rindfleisch, 31, along with Darwin W. Crosland, 40, and Ashlee Tinno, 29, were involved in an hour-long chase throughout Idaho Falls on the evening of Feb. 27. After the vehicle driven by Rindfleisch crashed into a snow bank, the trio fled on foot. Rindfleisch stole a pickup that he drove towards officers, striking an occupied cruiser. A Bonneville County Sheriff's deputy fired on the vehicle, killing Rindfleisch.

Bonneville County Prosecutor Dane Watkins Jr. determined in April that the deputy would not be prosecuted, saying the shooting was a justifiable homicide because Rindfleisch posed a threat to the officers and civilians.
The tort claim notice filed on Aug. 21 by Randy and Jerilyn Rindfleisch seeks unspecified damages and makes numerous allegations, including the following:

-- The killing was done by Bonneville County Deputy Sheriff Kip Davies, a newly-hired and inexperienced officer.
-- Rindfleisch was killed by four rapid-sequence shots in close grouping, indicating he was not moving.

-- The shots were fired despite an Idaho Falls sergeant specifically advising that deadly force should not be used.
-- There was insufficient leadership which resulted in multiple commands being given, and no non-lethal means were employed.
