Charges dropped against public defender
POCATELLO — Misdemeanor charges against Bannock County Public Defender Randy Schulthies, and the two other men charged in the same incident, have been dismissed pending certain conditions, according to court records.

Schulthies was cited on April 30 and charged with misdemeanor disorderly conduct after being involved in a physical altercation with two other men, Joshua Shook, 23, and Zeke Twiss, 18, both of Pocatello. They were also cited with misdemeanor disorderly conduct.

According to an incident report filed by Pocatello Police Officer J. Bates at the time of the incident, all three men said Shook hit Schulthies in the face and that Twiss wrestled Schulthies to the ground. Both Twiss and Schulthies said the altercation began as an incident of road rage. Both said Schulthies followed Twiss to 1066 Yellowstone Ave. in Pocatello after the road rage incident.
In front of Sixth District Magistrate Judge Eric Hunn on Aug. 5, Bonneville County Deputy Prosecutor Randy Neal, acting as a special prosecutor for the City of Pocatello, conditionally dismissed the charges against all three men.

According to court documents, Twiss and Shook both agreed to pay restitution of $300 total to Schulthies, which the public defender described Wednesday as compensation for noncovered medical expenses from the treatment of injuries he sustained during the altercation.
Schulthies agreed to complete a mental health evaluation and associated treatment.

Each of the three men is subject to having the charge against him refiled in the future if he does not comply with the conditions of his individual dismissal, Neal said.
“The emphasis is that a good resolution doesn’t always require criminal charges,” he said. “On the other hand, we aren’t just dropping it. We are asking them to do certain things before it’s dropped.”

Schulthies said he is still upset with Pocatello police because he was the victim of a two-on-one attack. He said a civil suit against Twiss and/or Shook is still an option for him, but he doesn’t believe it will be worth the time or money to pursue.
